Terms of Service
These Terms govern your use of Amicus, an AI companion service for adults. Please read them carefully before creating an account, chatting with a companion, or making a purchase.
1. Agreement and service
These Terms of Service (the “Terms”) form an agreement between you and Amicus, the operator of the Amicus website, mobile app, companions, calls, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and acknowledge the Privacy Policy.
If you do not agree, do not use the Service. We may update these Terms from time to time. If a change is material, we will provide notice where required by law. Continued use after the effective date of an update means you accept the updated Terms.
2. Adults only; accounts
You must be at least 18 years old and legally able to enter into this agreement to use Amicus. Do not use the Service if you are under 18. You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized use.
You are responsible for activity on your account. We may refuse, suspend, or terminate an account when we reasonably believe it is unsafe, unlawful, fraudulent, or violates these Terms or our Community Guidelines.
3. Amicus is AI, not a person or professional
Every companion, message, voice, image, and avatar response in the Service is generated or presented by software. Companions are not human, conscious, licensed, or a substitute for real-world relationships or professional judgment. They may produce inaccurate, incomplete, inappropriate, or unexpected output.
Do not rely on Amicus for medical, mental-health, legal, financial, emergency, or other high-stakes decisions. If you may be in immediate danger, contact local emergency services. Our Safety Center has additional support information.
4. Your content and use of the Service
You may submit messages, prompts, profile information, character instructions, images, audio, and other material (“User Content”). You retain any rights you have in User Content. You grant Amicus a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt, and display User Content only as needed to operate, secure, improve, and provide the Service, including through our service providers.
You represent that you have the rights needed to submit User Content. Do not submit content that is unlawful; exploits or sexualizes minors; threatens, harasses, or defrauds others; invades privacy; infringes intellectual-property rights; contains malware; impersonates a real person in a deceptive or harmful way; or attempts to bypass safety, access, rate-limit, or payment controls. Do not use the Service to build a competing model or service, scrape content at scale, reverse engineer the Service except where law permits, or send automated requests without our written permission.
5. Generated output and characters
Subject to these Terms, you may use output generated for you by the Service for lawful purposes. Output may be similar or identical to output generated for others, and Amicus does not guarantee that output is unique, available, accurate, or non-infringing. You are responsible for reviewing output before using or sharing it.
If you create or customize a character, you are responsible for its name, instructions, likeness, and other submitted material. You must not use another person’s name, voice, image, or identity in a way that is misleading, exploitative, defamatory, or unauthorized. We may remove or restrict a character or output that creates safety, rights, or policy concerns.
6. Calls, media, and device permissions
Some features use your microphone, camera, notifications, or other device permissions. You choose whether to grant those permissions and can change them in your device settings. Avatar calls and related media features may rely on third-party providers and can be unavailable, delayed, or interrupted.
Do not record, distribute, or use another person’s voice, image, or information through the Service without the consent and rights required by applicable law. You are responsible for complying with recording, consent, and privacy laws that apply to you.
7. Paid plans, renewals, and refunds
Some features require a paid subscription or one-time purchase. Before checkout, we will show the price, billing interval, and material limits of the offer. Subscriptions renew automatically at the stated interval until canceled. You may cancel before renewal through the billing method identified in your account; access generally continues through the end of the paid period.
Usage allowances, including call minutes and any add-on credits, are subject to the offer shown at purchase and may have expiration or non-rollover rules. Charges are processed by our payment provider. Except where required by law, payments are non-refundable; requests are handled under the Refund and Cancellation Policy.
8. Safety, moderation, and enforcement
We may use automated systems and human review to enforce these Terms, protect users, investigate reports, prevent abuse, and comply with law. We may block, remove, preserve, limit, or report content or accounts when reasonably necessary to do so. Automated systems can make mistakes; contact Support if you believe an enforcement decision was incorrect.
You can report concerns through the Service or by contacting support@amicusapp.us. We do not promise to monitor every interaction or take a particular action in response to every report.
9. Amicus intellectual property
The Service, including its software, branding, designs, characters supplied by Amicus, and other content we provide, is owned by Amicus or its licensors and is protected by applicable intellectual-property laws. These Terms give you a limited, personal, revocable, non-transferable right to use the Service as permitted here. No other rights are granted. If you believe content on the Service infringes your rights, contact support@amicusapp.us with enough detail for us to investigate.
10. Service changes, suspension, and termination
We may change, suspend, or discontinue all or part of the Service, including features, characters, plans, or integrations. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us or others, or if we must do so to comply with law. You may stop using the Service at any time and may request account deletion through Settings or Support. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—will survive.
11. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMICUS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMICUS AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
12. Indemnity and disputes
To the extent permitted by law, you will defend, indemnify, and hold harmless Amicus and its affiliates, providers, officers, and personnel from claims, damages, liabilities, and expenses arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.
Before starting a formal dispute, please contact support@amicusapp.us and give us a reasonable opportunity to resolve the issue. Any mandatory consumer protections and dispute rights that apply where you live remain available to you. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and disputes not subject to a mandatory consumer forum will be brought in the state or federal courts serving Texas.
